How to Get Title to an Abandoned Boat
Ok here goes....my neighbor was renting his house and the tenant left without paying rent and he was stealing power from the electric company (they have issued a warrant for this).

He left behind everything most of it was garbage. He did however leave behind a boat and the owner of the property told me that if I wanted to take it, so I did.

I called the Sheriffs department here in FL and they came out to make sure the boat wasnt stolen and it isnt but it is showing as registered to the YMCA. I am assuming that this was a auction boat and that the title was never transferred. If anyone would know how I can get the title into my name it would be much appreciated.

You can try and see if this site would be helpful.

How long ago did the tenant abandon his property?

The landlord has a duty to follow the law when it comes to abandoned property. I hope he acted appropriately.

It has been about 3 months and I do know that the landlord had him legally evicted had a warrant issued for stealing the electricity.

We aren't talking much of a boat here looked like it was a project boat.

That sight really doesn't help me much unless it is legal for the YMCA to sign the title over to me.

I also know that the landlord didn't do anything with any of the property until after the eviction.

It doesn't sound like the LL followed the law in regards to handling abandoned property.

    See > http://www.leg.state.fl.us/statutes/...715/ch0715.htm

The site I linked you to earlier tells you who you would need to contact in order to try and get a title for the boat.

It is still registered to the YMCA and appears that the tenant did not yet have it transferred. You are not going to get a clear title without going through the proper procedure (and even then it is no guarantee).

I have done this twice (although, not in the state of FL). One of the times it was abandoned property (many, many years abandoned). The owner listed on the title, did have to sign off his rights and did so voluntarily. The other time it was a lost title that never was transferred through the state and the property had transferred to several owners. That one took quite awhile to get done (thankfully all the previous owners were still alive).

    Re: Getting Boat Title
So is it even worth pursuing? I am only assuming that it was bought from they Y in a auction. If it is stilled registered to them wouldn't they be able to sign the title over?

I was even thinking I might be able to get this claimed as a abandoned vessel.

You'll have to decide if it is worth it.

Start with the Y and see if they have any record as to what they did with the boat.

Take it a step at a time, and if you feel the next step it isn't worth it, then let it go.

There is already a problem with the Y they no longer do boat auctions here and have no idea who to contact about who bought the boat. Thank you for the help. Would getting a attorney maybe help with this? As far as the LL getting the title?

I don't think you will need a lawyer.

The link I provided above will tell you what the LL needs to do about the abandoned property.

I would make sure that the abandoned property issue is dealt with first.

Once that is done then I would go to the site that tells you who to contact about the title of the boat. That is where you will explain the situation and take it from there.

    Possible scenario would be -
They will issue a duplicate title, it will most likely come in the Y's name. Then it could be transferred to you.
