    Burglary of a Habitation with Assault
    I am being charged with burglary of a habitation in a house that i have lived in with my girlfriend for 8 months. I was in the process of moving and opened the door with a key and found her in bed with another man. She became very irate and blocked the door for me to leave and she hit me and I put my hands up to defend myself. I left came back the next morning to retrieve my property. My question is how can I be charged with burglary if I lived in the residence, my license has this address, my mail comes to this address and i pay bills at this address and I still have property at this address.

    Perhaps because you had already moved out, even if you had not moved all of your stuff to your new residence?

    This is a serious charge. You need to either hire a Texas criminal defense lawyer, or seek a court appointed lawyer / public defender.
