Mature Minor Emancipation, in Illinois
Hi, I am sixteen years old, my name is jake and I live in Illinois. I really do [U]not[U] like my stepfather. But im sure that is kind of common these days right..the thing is, I graduate when I'm seventeen so legaly I cannot leave. My mother(to my knowledge) will not agree to sign the documents for my Independance. The reason I would like to leave is there is never a quiet moment with my stepfather. He will actually look for reasons to yell at me, just because im his stepson. He never yells at his daughter..to get the point across, we are always fighting (which sometimes will get phisical). My real father lives in Arizona, but my mother has full custody over me, and absolutly hates my father. He has a Job ready and waiting for me anytime there. He is even going to buy my plane ticket. He has a house, car, and possibly a future wife. He can easily support me. And after I get out of high school, i need to save money from the places im going to work so I can go to college. I plan to major in German and minor in Buisness, and Buisness management. none of this can happen if I cannot emancipate myself. I need people to help me understand all of the requirements needed to emancipate myself. Thank You :rolleyes:

There is a much easier way for this to happen than emancipation. Emancipation is quite rare and does not happen because you want it.
What would be simpler would be for your father to apply to have custody changed to him. It's not guaranteed either, but it is MUCH more likely to happen than your emancipation.

thany you for your reply!:)the problem with that is my father left to arizona to deal with his drug issues(which thank god he has went to rosecrance and has been clean for 2 years now) the Judge or Jury (im not sure) will not over see that fact, and that will just be a faited attempt and a loss of money..

You can see the Illinois emancipation laws here. At sixteen you can file an emancipation petition in Illinois. Among the other facts you must establish to emancipate, you must show to the court's satisfaction that you are "a mature minor who has demonstrated the ability and capacity to manage his own affairs or (ii) a homeless minor who is located in this State; and [that you have] lived wholly or partially independent of his parents or guardian."

I read your post and I see you mention places your going to work. Without a job you can forget whole thing. This job must enough income for self (keyword self) support! read the statute Aaron posted get the job and then comeback with any more questions

I do have a job right now. but ive got a job offer where my father lives too.thats why i said where im going to work

You missed the point emancipations are not granted based on jobs you might/will have!!
