    Washington State Speeding Ticket
    WASHINGTON STATE
    Hi there,

    Just wondering if anyone can help my case. I have contested a speeding ticket and now have a court date. I was wondering if i can plead NOT GULITY if the cop doesnt show up and get off scot free? If the cop shows up, can i still plead GUILTY and ask for a fee reduction? Please, any information on this would be much appreciated!

    The cop will NOT show up unless you issue the subpoena. In WA the CITATION and the officer's statement are the evidence against you. If you subpoena the officer and he/she does not show up, you may get it dismissed. If you subpoena the officer and he/she does show up, don't count on much of a fee reduction by changing your plea to "guilty with an explanation", but it sometimes happens. If you're eligible for a deferral, that would probably be the way to go.

    From what I understand, you have to specifically ask for dismissal from the judge otherwise he will reschedule the hearing date.

    If what you have is pre-hearing date, don't forget to waive it so that you don't have to go to court twice.

    I am not sure how to subpoena the officer and request for discovery, perhaps Barry could help. I know you can get the form off their website but now sure when is the good time to send it.

    BTW do we have plea "no contest" in WA? Unfortunately, WA doesn't allow traffic school.
