Custody Of 15 Year Old Son In California

I live in CA. My sons mom lives in AZ. He lives with me in the summer. But he wants to live with me now. He is here for Christmas and doesnt want to go back. His mom doesnt want him to. She said she is going to tell the police i kidnaped him. Is there anything she can do about it? I am filling papers tomorrow.

Just file the papers. Until there is a court hearing you are bond by the previous court order

At this juncture, it's a guessing game. How was paternity established? Was a support order entered, and under what circumstances? There has never been a formal award of custody or visitation?

Really? Since the OP has refused to answer the questions posed by Aaron there is no way of knowing IF this OP is breaking the law. He could very well be guilty of custodial interference and harboring a runaway.
