I Married An Illegal Immigrant - What Can I Do?
My husband and i got married in june 2007 and we live in connecticut,he is from Mexico and isnt legal. He has been here for about three years and he has been working about that long,we are also expecting, the baby's due in feb 2008.Weve alredy gone to a lawyer he said my husband would have to go back and wait 10 years to come back and that it didnt matter that he was married to an american citizen or that we are going to have a baby together,we filed a petision but they said he isnt elligable for ajustment of statice. Is he right that it dosnt matter, that it dosnt change anything and is ther anything that we can do so he can stay and if ther is who can i go to for help and what can i do so they wont take him???

You appear to be stating that he entered the U.S. illegally, and thus the information you have received is correct. He can't adjust his status, as he has no status to adjust. The only way I know for him to gain status would be to leave the country (triggering the ten year period of ineligibility to reenter), then seeking a waiver of his ineligibility. That would be a risk, so it's something he should discuss with an immigration lawyer.
