What's Left On My Record After A Deferred Sentence
I just got caught shoplifting at a Kohl's in ND. The police were called and I was "arrested" (not taken to jail but given a notice to appear in court and escorted out of the building). I am 22 and had a completely clean record prior to this incident, so I contacted a criminal defense lawyer and he said that my only option would be to try and get a deferred sentence. I recently just got a $225 court fine and a 1-year deferred sentence. I know that this will remain on my record for the time of probation, but I am wondering what happens after that?? Once I have completed the one-year probation period, the lawyer said that the record will be sealed. I have a job now, but my questions is that when I go to find another job in a couple years, what will show up on my record if the company does a background check? How likely is it that they will be able to see the arrest or deferred sentence on my record? Any information is greatly appreciated because I can't seem to find much on this. Thanks!! On a side note, this is not a proud moment in my life and was a very foolish decision on my part!
Re: Deferred Sentence..what's Left On My Record?
It should show as dismissed but they programs vary so ask your lawyer. Also to consider is the arrest record. This sentence I doubt covers your "arrest" record. Now most employers only ask about convictions and only search for convictions when running background checks but its possible some may not and this "could" be a stumbling block
