Emancipation To Another State
I am 16 and wish to leave my custodial parents house and live with my other parent in another state,I am currently at the other parents house for vacation, and broke the news to my parent in FL.,but they are not letting me go. The law in the state I'm in,Ct says if I run away once they can legally force me to return, but if I run away again then they can't touch me.
Will this count as me running away once, and if FL. makes me return what will be my options?
Re: Emancipation To Another State
You may revisit that law as I doubt your reading of it is accurate. By the way the court awarded custody to one parent if the non custodial parents allows you to live there against court order he/she could be in contempt. What you need to do is ask the noncustodial parent to petition court for custody change.
Re: Emancipation To Another State
He did this before when they had joint custody many years ago,but in NY,and it forced my mother to go to court in NY,out of state for her, making it really difficult for her to fight it,and they awarded him custody.
Re: Emancipation To Another State
Thats only way this is going to happen
Re: Emancipation To Another State
If we open the case in Ct,can he force the case to transfer in FL?
Re: Emancipation To Another State
He's a cop in FL and is throwing around a lot of legal terms, making it appear he can win this easily and that he can easily have the case transfered, making it impossible for my mother to fight,is there any truth to this?
Re: Emancipation To Another State
Anybody? I really need to know this information.
Re: Emancipation To Another State
If your father wishes to try to modify custody, he can go to court in the state which presently has jurisdiction and attempt to modify custody.
Re: Emancipation To Another State
Can he legally force me to return to FL while all this plays out? I know for a fact that if I do,he will do everything in his power to cut me off from my mother for a while, including my cellphone and computer, which are my only two outlets to speaking to her long distance.
He stated he can call the FBI and have me sent back,I dont know if this is true,I think he is just trying to scare my mother...
Re: Emancipation To Another State
Yes he can and yes he can do all he can to keep order in tact as is. This is not in your hands let your parents and their Attorneys do the work. You do nothing other than what your told. any acting up on your part may work against you
