Selling Personal Copy Of Training Materials
Practically every e book or training material that you buy on line comes with a standard disclaimer (?) - that you need the written permission of the publisher to sell your copy. What if I purchased an e book or a training course that came with CDs, DVDs, and/or a printed manual and I have now finished with it and I would like to recoup some of my original purchase expense by selling it as a used copy? What are the legal ramifications of that sale?
Thanks for any help.
Re: Selling Personal Copy Of Training Materials
It's a breach of contract. As for what remedies the contract might define? Read it and see.
Re: Selling Personal Copy Of Training Materials
Thanks for your response. What if I bought the new Barbara Streisand CD but didn't care for 2 of the songs after playing it and my friend wanted to buy the CD from me at a discount because it was now used. Can RCA (or whoever the producer is or label owner is) sue me for breach of contract?
Can you refer me to something on-line to read n the subject, please?
Thanks again.
Re: Selling Personal Copy Of Training Materials
You absolutely can sell a used CD/DVD without any worry. The fine print on the label amounts to a contact of adhesion, and furthermore it's void by statute:
"...the owner of a particular copy or phonorecord lawfully made under this title, or any person authorized by such owner, is entitled, without the authority of the copyright owner, to sell or otherwise dispose of the possession of that copy or phonorecord." 17 USC § 109(a).
