H1B And Misdemeanor
I was arrested on a misdemeanor domestic voilence charge in 2004. The charges were dismissed after i finished 6 months of anger management. I have got the case sealed as of 2007.
I am planning to go to Ottawa for my H1B stamping (first time). Can my record cause an issue in my VISA processes? Does it reduce my chances for getting my stamp?
Also since I got the case sealed, how do I get copies of the case and judgment? I sent in the request to the court but they said that the case is not accessible as it has been sealed. Thank you for any help.

Re: H1B And Misdemeanor
I was arrested in California (I was on F1 at that time) but not I work in Arizona.
Also should I mark Yes is the question about my arrest in my VISA form?

Re: H1B And Misdemeanor
If you were arrested and you are asked the question, "Have you ever been arrested", do you really need to be told that you have to tell the truth? Use some common sense.

Re: H1B And Misdemeanor
As far as any employment issues go, I can answer NO to such questions after the sealing of the case.
My question is, how does this affect my H1 stamping - if any.

Re: H1B And Misdemeanor
You need to either hire an immigration lawyer to review the details of your case, or consult a psychic. I don't have the information necessary to do more than guess.
Yes, committing crimes can interfere with immigration. Yes, this could slow down visa processing. Do I expect it to prevent you from qualifying for a visa? I don't expect that.
