Grand Larceny And Identity Theft Charges In New York
my best friends ex room-mate stole her bank card and took 200.00 out of her account. 100.00 at one atm and then the other 100.00 at another. she is cought on video tape so we are positive it is her. does anyone have any idea what she will get? the detective said they are gonna charge her with grand larcey which is a class e felony and two counts of identy theft because she took 100.00 out twice. however we were just curious as to what a judge might give her in new york state. as far as we know she used to have a warrant out for her arrest for 8 past vehicle tickets that she never paid and never went to court for. she was suppose to go too court a couple weeks ago for them and never went after the judge let her out on her own good will. So we are unsure if they reput the warrant out for her arrest or not. If anyone has any idea what she might get it would be greatly appreciated. Thank you.

Her sentence will depend in no small part upon her prior record.

The victim should be able to make an inquiry with the prosecutor's office, and get some sense of the sentence the prosecutor will be advocating.

It will depend on whether or not she has had other convictions in the past or not. She could simply get probation, or serve a few months to a few years/ First time offenders usually get off on Class E Non Violent felonies, rather easily in NY. Look at this site it will explain in better, http://www.new-york-arraignments.com/crimes.htm
