    Macys 3rd Degree Retail Theft In Michigan
    ok so last week i recently got caught shoplifting. the prices of the 2 items totaled up to 102.00.$ this is my first offense, my record is completely clean. although the LP told me to plea guilty because if there is another court date "macys people" will come and fight me in court. i think he was just scaring me so i plea guilty.
    and i also looked up the HYTA is available in my county, and should i plea not guilty and hopefully a prosecuter makes a deal with me? i CANNOT be convicted of this crime, i want to do anything to avoid having a misdemeanor on my record.
    i also realize there are civil penalty fees, which i am 100% okay with.

    Get an attorney and have him/her petition for the HYTA (assuming you are eligible.)

    but i have to find out from the court before my court date about the HYTA program? and then what do i apply for it,
    so would that mean i would have to plea guilty or not guilty to be in this program?

    Please click on the link I provided above. You can then go to the Michigan statutes from that link and read Section 762.11 - Section 762.16.

    You should seriously consult with an attorney - so you have the best chance of getting a second chance.

    What you need is an Attorney not somone who went through something similar! That advice could be wrong for your case and you stand to lose much.

    Lets go back to some earlier replies. Find an Attorney and ask about options. One such option might be diversion.

    Attorney fees vary but many offer free consultaion. Once you talk to Lawyer ask about Diversion as these programs vary

    first time offense. do you honestly think i should be worried about being convicted?
    i am a second year college student and i cannot afford to have this placed on my record FOREVER.

    The availability of diversion programs varies by county, and that option is not available in most Michigan counties.

    A deferred sentence, such as HYTA sentencing, is more likely if you qualify and you otherwise have a clean record.

    A local attorney can guide you through the process. Hire a lawyer, or request a court-appointed lawyer through the court.

    my incident happened a week ago,
    and i am no longer nervous.
    its useless to worry about right?
    just get legal help and thats the best i can do?

    i heard if i plea not guilty...my sentance will be lighter.
    i have a CLEAN SLATE...
    but

    if i also plea not guilty, i will have another court date and will that mean i will face macys reps???

    it was only 100$ will they make that effort to fight me?
    i am paying the civil demand...

    According to a news article dated Nov. 22, 2007, it was available to a teen that admitted to stealing a purse in Macomb county, MI.

    Do not rely on what you hear. Talk to an Attorney familar with both criminal law and HYTA. That is where you will get sound legal advice

    i'm going through the same thing right now with macys. they tried getting me to pay them $200. when i tried to pay it they told me they would just give me a reciept from the cash register. i asked them if they would type a paper up saying that i paid the full amount on this date to show the judge. the manager acted like i was crazy.my court date is on monday. i'm really nervous. i'm hoping that i can qualify for the holmes youthful training act. if you have any advice you could give me that'd be wonderful

    People have replied and told you: Get a Criminal Defense Attorney. How many people need to tell you this?

    Ok: Look:

    Plead guilty. You get the max sentence.
    Plead "I Stand Mute"...ask for a Public Defender (not free in a lot of areas) and take your chances.

    Civil Demand: Pay by Credit Card, Check, or Money Order so you have proof of payment.
