Do not rely on what you hear. Talk to an Attorney familar with both criminal law and HYTA. That is where you will get sound legal advice

Below is a copy of the motion that YOUR attorney would file for placement under HYTA:

    Quote:

MOTION FOR PLACEMENT UNDER HOLMES YOUTHFUL TRAINEE ACT

The Defendant, defendant’s name, by his or her attorney, defense attorney’s name, moves this Court for placement under the Holmes Youthful Trainee Act, stating in support the following:

1.On date of conviction, defendant pled guilty to conviction offense(s), statutory citation.

2.Sentencing in this matter is scheduled to take place on date.

3.Apart from this case, Defendant has no prior misdemeanor or felony convictions.

4.Defendant’s name, whose birthday is date, was years of age at the time of the offense, date of offense.

5.Defendant meets the criteria for eligibility to be placed under the status of youthful trainee contained in MCL 762.11 . State relevant criteria and how they are satisfied.

6.The circumstances of the offense and the Defendant’s situation indicate a very low risk of recidivism. State factual support.

For these reasons the Defendant, defendant’s name, asks this Court to grant his or her placement under the Holmes Youthful Trainee Act.

    Respectfully submitted,

i'm going through the same thing right now with macys. they tried getting me to pay them $200. when i tried to pay it they told me they would just give me a reciept from the cash register. i asked them if they would type a paper up saying that i paid the full amount on this date to show the judge. the manager acted like i was crazy.my court date is on monday. i'm really nervous. i'm hoping that i can qualify for the holmes youthful training act. if you have any advice you could give me that'd be wonderful

People have replied and told you: Get a Criminal Defense Attorney. How many people need to tell you this?

    Ok: Look:

Plead guilty. You get the max sentence.
Plead "I Stand Mute"...ask for a Public Defender (not free in a lot of areas) and take your chances.

Civil Demand: Pay by Credit Card, Check, or Money Order so you have proof of payment.
