Negligent Driving Charge Due to High BAC
My wife and I are in the Navy currently stationed in Washington. Recently my wife went out with a girlfriend and drank a couple of beers. When she tried to drive on base the police stopped her at the gate and said she smelled like alcohol, she was given FST's and failed. Her BAC was tested at .072 so she was issued a negligent driving ticket. She has a prior DUII Diversion in Oregon 2 years ago. She was not observed driving at all.
My questions are what is the worst that could happen to her and what are her chances in getting the case dismissed?

I wouldn't think she will get more then a small fine. A good attorney could probably get a dismissal though.
