Fathers Rights, If Identified On the Birth Certificate
I live in texas and my son was born a week ago in texas as well and when I was filling out the birth certificate I didnt give him his fathers last name and the father wasnt there to fill out the AOP forms. we arnt married and i honestly dont know where our relationship stands at the moment. I want to know what rights the father will recive if I do put him on the BC becasue he has asked me to do that, however his mother has been a very big concern of mine. She has mentioned taking my son away and running off with him. I dont mind her or any of his family seeing the baby and spending time with him as long as I am there but I am afriad that if by putting the father on the BC he has the right to just take our son and do as he pleases. I dont think he would do that personaly but again his family may try something and he could back it up saying that he aproved of it. Also if he is listed does that give him the same full rights as me or no? and does he have to do anything specific to help with the child even without a court order? I want him to be a part of our childs life but i dont want to risk losing my baby to someone i dont completly trust would take care of him the right way. please help.:(

If you are worried about custody and visitation issues, start a paternity lawsuit and have the court issue a custody order when paternity is established.

You can't just "put" him on the BC. Ask him to fill out the AOP forms. If he won't, then start a paternity action in order to protect your child.

Honestly, I would not file any paperwork yet. I say that because I thought that the best thing for my son was to establish paternity and get child support. Fast forward two and a half years, and I now know that I was wrong. His biological father calls every so often threatening to have me arrested if I dont take him to his house, which is not possible but still adds stress to my life. His father is over 5,000 dollars behind in child support, and the Attorney General of Texas says that they cant find him. I have a wonderful husband who is the only dad that my son knows, but I cant seem to get the courts to let him adopt him, even though his biological father hasnt seen him in a year and a half, and before that he had only seen him three times. I would wait to see how your relationship evolves, and see if he is going to be a positive influence in the childs life. I promise that it will save you A LOT of headaches in the future.
