I got my first ticket about a month ago in Henrico County, VA. It was for reckless driving.
1) Do the new reckless driving laws apply in Henrico County because I recall hearing about them throwing them out?
2) What should I do to plea my case so that I do not get a RD charge?
Please give any advice!
There are thousands of posts on the board about VA reckless driving, do a search. The RD laws are not new, only the additional fines to the state supposedly to fix the roads. Whether you should retain an attorney depends on the nature of the violation, what is normal in that particular county for your particular violation, your prior record and your ability to handle yourself in court.
I heard one circuit court judge ruled the new fines were unconstitutional but I would think that is being appealed. Untill the VA Supreme Court rules the state will keep collecting the money and you will not get it back.
