Leaving For Egypt

I am a single mother of one child, she is 13. I left my husband when i was 8 months pregnant due to the fact that he was physically abusive towards me. I had my daugter in 1994 but I wasn't able to get my divorce until 1998 due to financial matters. My ex husband had only seen his daughter twice in her whole life for an estimated total time of maybe 2 hours her whole life. I was granted full custody of my daughter and allowed to leave the state with her. A parentity test was issued (he denied she was his) and I was able to prove that she belonged to him. His name was never put on her birth certificate, his choice, and he was court ordered to pay child support. I only received a total of $800 dollars in 13 years. Now the issue that I have is that I plan on remarrying again and my fiance' is in another country, in Egypt. I plan on marrying in that country if I can but I need to bring my daughter with me. Now I need to know, do I have to have permission from my ex husband, her father, to get a passport and take her out of the country since I have full legal custody of her, he has never been in her life and out of these past 13 years, he never plans on being in her life, he doesnt even pay child support and like I said, his name isnt even on the birth certificate. Can someone please, please help me on this legal issue. I just want to be able to get a passport for myself and my daughter to go to my fiance' to get married. Also, is there anyway that I can possibly take my ex back to court to have his parentity rights took from him, I do not wish to recieve child support if he agrees to give up his rights to her. If anyone can help me on this matter I would greatly appreciate it.

You will need your ex's signature/permission before you can get a passport for your daughter.

IF he refuses, first try making him an offer- if he will give permission and sign for the passport, in exchange you will forgive all arrears owed.
IF he still refuses, you'll need to file in court to get a court order allowing a passport without his agreement, you can also request payment of all arrears and future support. Under the circumstances, it's a good chance that a Judge would allow the move, since your ex hasn't been involved and owes a huge arrearage.
