    Refinancing Mortgage On Property With A Life Estate
    I live in Massachusetts and my husband and I own a home with a first mortgage and a home equity loan. The property was purchased from my mother-in-law and she lives with us and has a Life Estate which is also on the deed. The problem is, I can't find a lender that would let us refinance our home equity loan with the life estate on the deed. The last time we had refinanced the life estate had to be removed and after we signed it was added back on. My mother-in-laws attorney states he can not take it off again and that there are ways around this. The lender we were dealing with would not approve us as they said they do not deal with life estates. My mother-in-law is not willing to take it off again but may be willing in the future. How do we get around this?

    You can purchase her life estate.

    Thanks for the response. However, how can we get her to do that if she isn't even willing to take the Life Estate off at this time?
    Is it possible to have a Life Estate on a Legal Document instead of the deed?

    Talk to your lawyer (or have her talk to hers) about the possibility of using a life lease instead of a life estate.
