Hi. I am from Queens New York.
History: Single mom - 2 daughters aged 16 & 19. Divorced for 10 years.
Problem: I recieve child support from the Support Collection Unit of New York. My exs company deducts from his pay to an account at SCU that sends me support weekly. Recently, the amount I recieve each week has been lowered by over $100 a week. When I called SCU to inquire they informed me that another support order was issued for a child (2 years old) with his current wife. They told me that legally not more than 55% can be take from my ex's pay and that this new support order made the amount over 55% so payments to me had to be reduced. Even though the amount I recieve has gone down, the amount in arrears goes up accordingly (currently about $4000. in arrears to me.). I have found out that the amount of child support he is ordered to pay to me was never mentioned in the case for his new child's support so the amount for this child was very high.
I believe that my ex and his current wife are not even seperated and that she files for support just so my weekly child support would go down. The amount in arrears does not help me with the expenses I have NOW. What can I do?
