    16 Year Old Needs Emancipation Help
    ok heres my problem..
    My custodial parent is my father but he has recently kicked me out of the house and will not give my mother custodial rights and he wants child support. My mother does not have very much money to take it to court so we were thinking of a emancipation. My father will disagree but my father has neglected me and abused me but hes hooked up with the county sheriff department and child protective services. The child protective services has told my mother if she ever tells anyone of my abuse they will take her to court. So does anyone know what we can do.
    I know the rules of the emancipation and that stuff but what shall we do.

    You're not going to get emancipated in Florida unless your custodial parent initiates the process.

    The problem with changing custody is what? That your mother was deemed unsuitable in a prior protective services investigation?

    no she has not but there have been calls we don't know about and they are blaming my mother for false acusations and threating her but how would we go about getting a emergency hearing and remember i am KICKED out of my custodial parents house and Living with my natural mother and i wanna stay with my mother but my father will not turn over the custodial part an my mother lives far from my school and has no transportation to school so? by law can we force the issue for my to go to my other school closer to my mothers..

    its effecting my life in many ways. like waking up at 3:30 to catch a bus at 4:30 in the morning and getting 6 hours of sleep cause of getting there and back takes a while and that stuff

    If you want to be emancipated your parents or legal guardian must file the petition. If change of custody is issue then ask your parent(s) to file for modification of custody

    thats what we are trying atm thanks for your help guys and if i need more i will post later but for now peace and hopefully the panic will stop

    also take this into note i am 16 male and the protective service lady told me that i should be able to choice at my age who i shall live with.

    she also said your parents telling you nvr to come back or they will call the police is not being kicked out. modification of custody takes time and my fathers making everything hard. he destroyed projects that was due at school and is keeping my school books and only let me take about 3 pairs of clothes but i am very grateful i got atleast something

    Technically since you are a minor and under his court ordered custody, he can't just kick you out without risking criminal charges for child neglect. If you were to show up at his home (formerly your home), the police would give him two choices: either he lets you in to live, or he goes to jail. I always used to get a kick out of the looks on the parent's face when they were getting cuffed and stuffed for refusal to let their minor child back into the home. If your dad won't play ball, show up there with the police. At the very least, they will standby while you collect your other possessions, clothes, school books, and give your father a little education about his responsibilities as your guardian. Then if he doesn't WANT to be your guardian, he can take steps to petition for another person to take that role.
