    My New Husband Adopting My Daughter
    I'm about to get married to my fiance and he wants to adopt my daughter. My ex doesnt have anything to do with her, (visitation or support). I live in South Carolina, he lives in Ohio. Is there any way to force him to sign over his rights on grounds of neglect or anything like that? He wont sign over his rights because of his mother. Is there anything I can do about this?

    Has your ex been legally adjudicated the LEGAL father? Is there any court orders?

    He is on the birth certificate. We have a court order for child support and he has paid 275 dollars in a year. I have a court order that his visitation is supervised to my descretion, because he has been in a mental institute for bi polar.

    Michelle read through these threads before going any further. You will see some pleasant some not discussions on this very topic. Its not up to you to decide that the Father is no longer fit to be Dad and your new husband is. If you want this to go smoothly ask your Ex to give up his rights then proceed with adoption. If he objects then its pretty much over.

    Are his symtems under control now? Bi-polar disorder, if under control, isn't something that would place the child in danger. Who created the distance...I would imagine it would be hard for him to visit with his child because you are in a different state.

    In order to have his rights terminated you would have to show abandonment. He is paying "something"...not much...but something...You will be in a better position for a TPR when you are married for a period of time.

    She is my daughter and I will protect her. If I feel that her biological father is unstable and may pose a danger to her, then it is up to me to decide. He's never had anything to do with her. The only reason he wont sign over his rights is because of his mother. We are in court for her grandparent rights and if he signs over his rights it terminates her rights, so she told him she would dis own him if he did that.
    I moved to be closer to my family, he thought it was a good idea he had no problem with it because he has never been a part of her life.

    Its going to be an uphill battle then. If you feel him unfit or dangerous then best start documenting facts now.
