    May an asylee bring a fiance into the USA
    Hi there,
    I just found out this site, and I thought it would be my chance to ask this for my friend.

    My friend came in this country in 1999. He was married at the time and left his wife in the country. Due marriage issue, he was not They both decided to file for divorce.

    My friend just told me that he has been recommended to another girl in the same country where he came from as asylee, and he would like to marry this girl.

    They have been in relationship for three years now. My friend is confused because he doesn't know what to do to bring his fiance here in USA so that they can get married. What is your recommendation to this situation? what options can he consider to bring this girl in the country for marriage?

    Derivative Asylum for Wife or Child
    The USCIS provides information on derivative asylum for a spouse or child. There is no provision for a fiancee unless and until you qualify as a lawful permanent resident.

    If I understood what you have mentioned, do you mean that if I become lawful permanent resident I will be able to file for my fiance?

    Is there any other legal options you could advice me to go through to bring my fiance in this country as soon as possible?

    You cannot sponsor/petition a Fiancee to come to the U.S. as long as you are a Permanent Resident and not a citizen, Only U.S. citizen can...

    Having said that, you can marry this person abroad, and file an I-130, however the wait time for a visa is 4-5 years...

    You should consider other nonimmigrant option. It really depends on the alien's qualifications. You should consult with an immigration attorney.
