    Parent Wants Emancipation From Child In Indiana
    My ex husband wants to emancipate my 20 year old son so that he will not have to help pay for anything. I don't care if he does this as my son is considered an adult BUT, I do not wish to emancipate my child. Wouldn't this create a problem for me when he goes back to college full time and I want to place him on my insurance ( health and dental ) if he is no longer considered my dependant ? Is a partial emancipation available for my ex ? Since he is the only one that doesn't want to help his son with anything ? Can I still claim my son as a dependant if he is emancipated.

    Is your son living independently and supporting himself?

    No he is living with me. He does have a full time job and is not currently in college ( he missed one semester) but, will be going back next semester ( part time). He does not make enough money to support himself even with the full time job. I help with his car repair, dental insurance,etc...

    I no longer care about the child support but, I do not want to be emancipated from my son. won't this take away any option of helping him with insurance, or on taxes as he would no longer be my dependant ? Is there a partial emancipation that my ex could get but, not include me ?

    Your son is already a legal adult, the age of majority in Indiana being 18. The type of emancipation your ex- is describing is for purposes of child support. It sounds like your son remains your dependent, so I'm not sure why (if the order provides for continued support under the present circumstances) your ex- thinks he can convince a court otherwise.

    In any event, if you both wish to terminate child support, you may be able to get the court to do that without getting into the details of your current situation.

    Hello !

    I do not want to emancipate my child. My new health insurance allows me to cover a dependent child to age 25 whether they are a student or not. I do not have the option to cover him if he is emancipated from me. I know that my son is 20 but cannot live independantly without another means of help. I do not care about the child support but, I am carrying all the other things that My son cannot afford yet ( i. e. car repair, insurance, dental, eye care, food, shelter) i want my ex to pay for his health insurance. ( which doesn't seem like too much to ask). since he insists he cannot on his insurance, I want him to pay the 1600.00 a year difference to cover my son to age 21 ( which is the year 2008).
