    Tax Filing Status After Death of Ex-Spouse
    I am wondering what I need to file as in my upcoming 2007 return.

    My divorce was final in January of 2007.

    2006 returns I filed as Married filing separately.

    However, another issue is my ex wife passed away about 2 weeks ago from excessive alcohol (liver cirrhosis) .. she was 34 and that was the reason I filed for divorce in the first place.

    Now, I changed my federal and state filing statuses to single 2 I believe as I have our daughter .. I did this back in january.

    Can I still file as married filing separatly?

    single?

    what am I supposed to file as?

    I am in Michigan.

    Your filing status will likely be head of household.

    As of the divorce you are single. The death of your EX wife has no bearing on your filing status. You may file as Head of Household if you meet the qualifications.
    The above assumes that there are no issues with regard to legal seperation or any other reasons to be concerned about 2006.

    I had heard somewhere however that even if I am married as of January, I have to file as Married?

    Your marital status for filing purposes is determined as of the last day of the year.
