    Help With Florida Emancipation
    I have read the emancipation laws reguarding FL many times. I mostly get them, but the issue I am having at hand is even how to start the process. And here is what I am dealing with:

    My mother has custody of me, and my father has visitation. My grandmother is sick of the enviroment I am in and is wanting to get me emancipated so I can go to NY with my aunt (while getting a job and continuing school to support myself) and further continue my education there and actually have medical help (my mother neglects my medical needs and my living conditions are VERY poor). My father agrees with the choice, but I am sure my mother would not. So what actions would needed to be taken to go against only her? I need it in words that I can understand, the legal talk is not exactly my strong suit.

    And my grandmother, aunt, and I are all wondering how to even begin the process. I am in my sophmore year of high school. I need to know my options and what actions are needed to take at this point and advice, or even my right to go against my mother due to my living conditions and her neglect.

    In florida your parents have to file the petition for emancipation.

    I just thought it would be important to mention, my mother did get custody of me (and my younger brother) over 11 years ago, and the only reason my father didn't get custody is because my mother scared him away with saying he was gay in court (seeing as it was much less acceptable back then).

    Would he be able to go against her with what knowlege is has of my living situation, and also, if I were to get emancipated, what would happen to my younger siblings within the household.

    But it also says that a guardian ad litem can file the petition...I need info on every option I have.

    My health is in question in this situation. My mother applied for medical insurance once and didn't get it and refuses to try again. And I am in deserperate need to be in a place where they will not deny my needs.

    There has to be a way to go against her with the neglect alone.

    Your Mother and Father must file the petition if they will not its over

    Even if they did file for you to be emancipated do you have a job you can support yourself 100% on, can you provide your own insurance?

    Can you pay for your own place and all utilities included?

    Only my father will agree to the petition, and I'm pretty sure my mother has sole custody of me.

    I don't even know where to begin here.

    I would be going north and live with my aunt and get a job up there and finish my studies up there.

    We're still working out the details. My aunt, my father, and my grandmother have all been discussing it. My father agrees to the arrangement. But my mother would not agree to it because...well basically I'm her live in maid. She wouldn't even let me be with my father for a summer before.

    emancipation is about self support this is not self support!

    Whatever, it doesn't even matter, I suppose. Since I am being told something different than the law provides anyways. If my mother won't comply, then I suppose different action would need to be taken, maybe not emancipation, but that was my grandmother and father's idea. I can have a job when I have the ability, but as it is right now my mother will not let me (I have previously worked).

    Emancipation is not an option for you as you would not meet the requirements and your parents will not file for you.

    If your seeking a change of custody or guardianship your father will have to go through the courts to do such a thing, not you.

    Well, that is not an option for him either. So I suppose I'm stuck in my home until I'm 18.

    Honestly, I can't stand FL. It's a horrible state. And FL DCF is not much better, or me and my siblings would no longer be in my household.

    On what grounds do you believe you and your siblings should be removed from your home?
