Ex Wants Custody, but I'm Afraid of His Wife
Support case in WV. I moved recently to Ohio.
I have a 2 year old. I was on welfare for the first two years because I didn't want any help from the father. I just didn't want him to know he had a son. Well because of TANF I had to give them his name. Once CS proceedings started he and his new wife called cps on me because of rumors they heard about drug abuse and me not providing for my son. They found nothing wrong. His wife gave my number out to men pretending to be me and men were calling me all hours of the night. I had my number changed.
Then I got messages from his wife on myspace calling me names calling my son a b*stard. Saying she did not want my son around their family. Saying she would have her son beat him up if he ever showed up at their home in the future.
So I moved and I did not tell my ex where I am at. I'm supposed to tell him within 14 days. But I'm afraid for them to know. Neither of them have showed up at my house. They lived 180 miles from me. Now they live about 250 miles.
My ex found my address. His wife called my boyfriend that I'm living with and he confirmed I live here.:mad and then she proceeded to tell him a bunch of lies about me. And now my ex is filing a contempt petition for failing to notify him of my new addess. Can he do that since I moved so he and his wife wouldn't know anything about me due to the allegations of child abuse and the harassing messages on myspace? Is that an appropriate reason to violate the court order? Or will I get in trouble? He also wants to file for some type of visitation. But I'm afraid because of his wife. He's only doing this to make my life miserable. He and his wife have stated verbally and I have no proof that he just wants to show me he can get custody and then never use it.
Plus he plans on debunking the messages his wife sent me on myspace by saying that I created a profile and put his wifes picture on it and sent myself the harassing messages.

Yes you will get in trouble for violating the court order. There is NEVER a "good reason" for defying an ORDER from the court.

Loss of custody, fined, ordered to pay for your ex's legal fee's, jail...
It depends on the judge really...Most likely you will be ordered to bring the child back and pay fines and legal fees.

If you violate a court's custody order and intentionally keep a child away from the other parent, one possible consequence is that you lose custody.

He does NOT have custody. There is no custody arrangement. I just didn't notify him of where i moved to. He wants custody. But hasn't filled out paperwork for a mediation. So since he has no custody rights how am I keeping him from my son?

By you own posting (below quote) you are denying him access to his child. You were court ordered to notify him of a change of address...You defied this COURT ORDER. You moved without permission of the courts ,(you don't have to have a custody order to be required to get permission for a move out of county/state), without written permission of the father and have attempted to hide said child from the father. For someone who is so frightened to have to provide her child for visitation to the other parent, you are really going out of your way to loose custody.

If you want people to tell you that you can violate court orders with impunity, nobody with an ounce of knowledge or sense is going to tell you that. The court has issued an order, and you have been informed of the possible consequences of ignoring it.

So no one thinks the harassment i recieved from his wife is enough to move like I did? Is there a good chance he could get full custody because of what I did. Is this considered parental kidnapping?

If you want to raise the issue of his wife's conduct with the court, nothing is stopping you.
