I remembered this case name from past research and it turned up. It is a decade old case from KS's court of appeals. Scroll down to find any california citations in the body. If case law holds true today, yes, I agree with BSG, it is a "conditional gift", if I am reading it right, and must be returned. Further research may be required by yourself at a law library or you can consult an attorney.
