How Do I Marry My Illegal Boyfriend
I am from Wisconsin and have been with my boyfriend for 7 years. He came here illegally about 12 years ago. I would like to know how the laws would apply to us if we were to get married. We both went to visit his parents in Mexico in 2004, I flew back and he crossed the border. He has a sister in California, who just recently became a permanent citizen. He also has two children here. One was born in Mexico and is 15 the other is 8 and was born here. We both have good jobs, and would like to get married, buy a house and all the normal things couples do. Is this possible for us?

You are stating that he entered the country illegally? If so, he cannot adjust his status on the basis of marriage.

okay so what are our options? Do we just live the way we have and hope for the best, or is there something we can do? He is a great person, who works hard and takes very good care of me.

There's no realistic chance of any form of amnesty program in the foreseeable future. He can discuss his options with an immigration lawyer, but they are few.

So there really is no way for him to become legal, at this time anyway? He works for a very successful company and has been there for 4 years. If he returned to Mexico and tried to get a K-1 visa, he wouldnt be eligible to return to the US? We will try to find an immigration lawyer, but if anyone has any suggestions I would love to hear them......thanks!:D:D:D

I just wanted to let you know that I'm right here with you. I married my husband (Illegal Immagrant) 7 years ago. We had to find a county that didn't require the SSN. Now we have applied for the I-130. We hve a long way to go, but I just wanted to let you know it is NOT impossible for some one who enters the US illegally to get a green card just alot harder. He will eventually have to go back to his country for an interview, but our lawyer has advised us to wait until he gets an oppt. date. We will have to get an afadivte of support (his income will not count so your income alone will have to be able to support your family including him. Goole affadavite of support and you can find out how much you need to make) If you don't make enough you have to find someone who will do it for you. You will have to prove your marriage is true. And the hardest thing to prove is that there will be a hardship if he had to go back to his country and that you couldn't go live there. Our lawyer told us that our children do not count, that we couldn't use them as an excuse. There is so much more that needs to be done and I'm sure alot I still don't know about. Plus the fees are exspensive and they just got higher a few months back.
For you i think the first step would to be get married so you can file for the I-130. i wish you all the best.
Oh, one more thing. The lawyer said the best way to prove a marriage is throught the last 3 year tax returns. So start filling together. Even though he doesn't have a SSN you can apply for a ITIN number. I'm not sure if you have children,but this will knock you out of claiming EIC, but will help you guys in the long run. Good luck!!!
