Trespass Law in Texas
TEXAS. A homeowners' association, a private corporation, changes its deed restrictions to allow the association the right to enter upon an individual homeowner's real property at their discretion without committing trespass. These changes are agreed to by a majority of the homeowners. Presumably those homeowners who agreed to accept this change can no longer deny entry to their real property by the association. But, can the association enter upon the real property of a homeowner who did not agree to these changes? In essence, can a group of homeowners, acting through the agency of a private corporation, take away the legal rights of others as granted by state and federal laws?
