Garnishment Above 30 Times the Federal Minimum Wage?
Hi again,
I have more questions. I keep seeing this guidline for ganishment amount and I wondered if I was understanding it correctly.
So, if it says 30 times the federal minimum wage ( which is now $6.55/hour) that they are garnishing everything over that amount, that basically means they are leaving you with 30 hours of $6.55 an hour, per week to live on? Ouch!!
That hardly seems like an appropriate amount to leave a person to live on. It boggles my mind that they are able to garnish people living under the poverty level.
Anyway I was just curious if I was understanding that correctly. Maybe I should consider myself lucky that I am only being garnished at 15%.
Oh, a couple other questions...can they garnish more than one employer at a time? And can they keep your income tax return and earned income credit if your already being garnished? This would be in Nebraska.
Thank you very much.
Re: Garnishment Above 30 Times the Federal Minimum Wage?
You seem to be alluding to this federal rule: For ordinary garnishments (i.e., those not for support, bankruptcy, or any state or federal tax), the weekly amount garnished may not exceed the lesser of two figures: 25 percent of the employee's disposable earnings, or the amount by which an employee's disposable earnings are greater than 30 times the federal minimum wage (currently $5.85 an hour). Some states impose additional limits on wage garnishment.
If you are collecting wages from more than one employer, they can garnish more than one employer. If you are expecting a tax refund they can attempt to garnish the tax refund, within the confines of any state or federal limits on garnishment.

thank you for clarifying.
