The other times I stole, (and this time for that matter), I did not pocket the jewelry right out in the open; I brought it in the fitting room with me and took if off the package and stole it there, where there are no cameras, so they cannot have film of me actually stealing. The only way they knew i definitely stole this time was someone went in the fitting room after me and saw the packaging.

Its very simple, A camera saw you with the items, you entered a dressing room, and then when you exited it, the camera saw you without the items. And I'm sure if they alerted someone and that person went to check the dressing room they didn't find the merchandise you went in there with, therefore came to the conclusion you had stolen it.

Yes but at this point they're not going to be able to prove that the items weren't in the fitting room after I left. Also, I didn't steal all the jewelry I went in with, I left a few pieces in the fitting room and the camera probably couldnt tell exactly how many pieces I went in with.

These camaras have zoom capabilties in most cases. So much they can even read the tag for some. So yes they knew what you went in with and what to look for in fittingroom. Even if they didnt they saw X amount of items selected and taken with you into fitting room. Upon your exit none of theitems were seen. Inspection of fitting room finds no merchandise. Items did not fall into a black hole so there only one place they could be, on your person. Finding the merchandise (even some of it) once stopped confirms theft. Just a note not all retails allow LP to make fittingroom stops however I am unaware if Kohl's is one of them

Rather than debating this endlessly.... If you believe they can't prove you were stealing, "tell it to the judge". If you are so inclined, demand a trial and see if you are convicted or acquitted.

Maybe he went in the fitting room area and gave the items to a friend who was already in a both, before he went in another both. And someone like you stopped him for stealing nothing.

Or he could have hid them in the ceiling tiles in the fitting room?
Or the girl you asked to check the fitting rooms, didn't check them correctly.
Or he did steal them, but as you were leaving the cameras to get to him, you missed him dumping the items under a rack before he exited the store.
Or he could have been going to a party and want to change there, he bought the stuff before you started watching him, he went back to the rack to check out others, then went to the fitting room to put them on.

Okay but I still don't know whether to return the other stolen merchandise or not. I'm scared to death there's going to be a warrant for my arrest if I don't, or if I do they'll immediately call the police.

If you wish to be advised on the consequences of retaining items you have previously stolen, consider retaining counsel, and follow the advice of your lawyer.
