    Changing My Children's Last Name

    I was recently married. Both of my daughters have my maiden name. They have the same father; however he only visits with one of them (his choice). He will consent for my youngest for that reason. Both of my children have been using my married name in school, with friends informally, etc... Because my ex will consent for one child, do you think the courts allow my other daughters name to be changed without his consent.

    It makes it much more likely. (As you were told when you posted, laws are different in each state.)

    Are you saying that the children are enrolled in school and using a name that is not theirs? I'm curious as to know why the school is allowing that if that is true. They are leaving themselves wide open to some legal issues, as is the OP.

    No, they are not enrolled using a different last name. They just write a different last name on their school papers (homework, tests, etc). The teachers know who they really are. We are in NY state.

    Do yourself a favor and save everyone a lot of aggravation, have the children use their legal names on everything until the name change situation is resolved. If for some reason your ex decides to flip the script and make a fuss, this can turn out very ugly for you...
