Wrongly Arrested
Hi all,
I'm a Canadian citizen that will be applying for an H1B this spring. I was wondering, will I ever have to encounter the dreaded "Have you ever been arrested?" question?
As a bit of a background, I was wrongly charged of a misdemeanor sexual assault but the charges were dropped and records were expunged. I was confronted once by a border official while applying for a J-1 but I was honest and they eventually gave me the J-1 after I brought back court documents showing the dismissed charge.
I subsequently had two J-1 and am currently on a TN-1 without any problems but I'm still deathly worried that I will get denied.

From what you say, U.S. immigration is already aware of this incident, so if you're approved for the H1B I doubt that you will have any problem at the border.
