Filing Divorce and Moving Out of State with Consenting Kids
I have filed for divorce and will need to relocate from Mississippi to the mid-west for employment. I have 1 child in 2nd yr of college that may come later, 2 children, ages 14 and 16 1/2 that are looking forward to the move. Can I do this without father's consent and without his knowledge? Father is still living in same household but will be served papers this week to remove him from home due to creating a hostile environment. He is a functioning alcoholic with gambling addictions and occassionally uses other people's Rx's (valium) to get high. HE disappears for days at a time when he goes on gambling binges. He has taken me off our joint ck acct. He still pays the bills and give kids their money for school but has not given me a penny since Oct.21, 2007. He TAKES me to the grocery store and wherever for needed items but will not give me the money to do so. We've been married over 20 yrs. and I've always paid the bills, did my own shopping etc. But I even had to ask him to get sanitary items cause I had no money. I am not going to live like this and I've put him out several times and he weasels his way back in and things seemed to be better. But would eventually start drinking and gambling again. My kids want this divorce and relocation so we can put some distance between us and he'll hopefully leave us alone. Please advise.... Thanks!!!!

If he opposes the move, you should seek permission from the court.
