Fighting Back

I received suit papers on a credit card that was charged off over 4 years ago. I live in GA and believe the statute has expired.

I have never been given an account number, heard of the collection agency being represented, and they are refusing to provide this info.

Can I refuse to answer plaintiff first requests until they provide me with this information? What O.G.C.A statutes address my rights and what are rules 5.2-1?

You have to answer their discovery, and should do so in a timely manner; if you want to take discovery from them, serve them with discovery requests in proper form.

Answer them because if you dont they might be admitted as facts for your failure to asnwer. Read the Rules of Procedure and type up your own Discovery to serve them with. Or hire an attorney.
