Caught Shoplifting On Camera at Niemans, Called at Home
My wife has previously (within 12 months) been convicted of shoplifting at Niemans and is on probation. She got a call at home today from Niemans saying they had her on tape and if she returned to the store within 1 hour and returned the merchandise they would let her walk free. She is scared and has not returned to the store, what evidence do they have and can they arrest her even if she is not in possession of the merchandise???
Its a big black hole for me on this one so feel free to ask me questions. I am just :wallbang: with the whole thing!!!!!

If they have her on video she done. She might as well return the merch but say nothing! they have her name number address etc so if they want to press charges it wont matter if she returns or not. She might as well take the chance and return the merch

She might also seek help since it appears she has a problem. If she does send me a PM I will put you in contact with the Director of NASP they have an excellent program that courts smile upon so it could help a lot

Thanks for the advice. Will drop you a line for the info. We are looking at hiring an attorney who may be able to get her off if she just returns the merchandise! We'll see!

If your hiring an Attorney ask the Attorney to return merch or ask him/her to go with you. Also ask Attorney (if charges are filed or probation is violated) how your local courts react when accussed enters a program lik eones NASP offers

It would be better for you to return the items without her. If she goes, plus if they do paperwork on her, she will receive a "Civil Demand Notice", and have to pay a fine down the road. If it's truly "only" the merchandise they want, that should be OK.
