Hit-and-Run in a Paid Parking Lot
Hi,
I am from Massachusetts.
My company pays (a lot of money) for me to park in a private parking lot when I go to work. Few days ago, when I got home from work I noticed that the right back side of my car was scraped. The scrape wasn't there before and I am 100% sure it did happen in this parking lot. I went to the manager of the parking lot but he told me that their company is not responsible for any damages that occur to the car while it is parked there, and that it can't be proven that the damage happened there. I never signed an agreement with this parking, and this information is nowhere disclosed, I just have an access card, which I got from the company that previously ran the parking lot; I did sign an agreement with the previous company saying that if something happened to my car they wouldn't be responsible. The lot is monitored by camera but they say that they just monitor their shuttle buses and don't monitor the cars. I have some reason to believe that one of their shuttle buses hit my car since I was parked in a lane where only buses park (the manager told me to park there, since there was no other parking space). The whole thing is a mess. I am really frustrated considering that for three years my company has paid $95/week for my parking spot, and these people will do nothing for me. I don't know if I should go after the parking lot company, and if I have any basis to do so? Should I just contact my insurance and have the car fixed? Will my insurance cover this damage and will that affect my premium?

If you have comprehensive insurance and the damage is classified as such by your insurance adjuster, it will probably have no effect on your premium. If it happened several times, it probably would. Your situation is very frustrating...and those things happen all too often.:(

Something similar happened to my daughter's car. Our insurance company handled it as "uninsured motorist" coverage ($100 deductible) as opposed to collision ($500 deductible). Call your agent and ask.

That is what non-inusured insurance is for. If you really believe it was one of the shuttle buses, and you are really determined on finding out. Then take a day off work and check out the shuttle buses as they come in. Or post a message requesting any information, someone might remember something and fill you in. However since it happens everyday, unlikely anyone will remember anything. So do your own investigating work if you really are determined,

That belief is usually incorrect but widely believed. Standard uninsured motorist provisions cover medical costs, lost wages, emotional distress, pain and suffering and loss of future earning potential of the insured party..... but not damages to the vehicle. There might be some exceptions with some companies in some states but, generally, that is the case.

I suspect that the payout described above was under the vehicle's comprehensive coverage, not uninsured coverage.

"Comprehensive", at least with my policy in my state, covers theft, broken glass (windshield or headlights), fire, vandalism, etc. Any time there is a collision, it is handled, interestingly enough, under "collision" coverage. In fact, some companies refer to "comprehensive" as "other than collision" coverage.
My agent explained to me that damage in a parking lot, where you don't know who hit you, is still "collision", unless there is reason to believe that it is vandalism-related (very rare and very hard to prove). However, even though there was a collision, they routinely handle it out of the "uninsured/underinsured" coverage.
My "collision" coverage is $500 deductible, my "uninsured/underinsured" motorist coverage is $100 deductible, but my "comprehensive" is $0 deductible. If it had been handled under "comprehensive" I wouldn't have had to pay anything. If it had been covered under "collision", I would have paid a $500 deductible. However, I only paid $100.
Perhaps policies in different states or from different companies are, indeed, different. I can only relate how my policy was applied in my state. As my agent said, "'Comprehensive' never pays for a collision."

I agree with that, but I still find it more likely than "uninsured motorist" coverage, and we've already ruled out collision coverage. (My comprehensive has a $100 deductible, although I can pay for for a lower deductible.)

For me, the difference in cost between $0 deductible and $100 is $8 per year. If you have to have just one windshield replaced over a 12 year period, you're money ahead. I highly recommend $0 deductible comprehensive -- but that's just me.

For me, it's about $50 per year, so....
