Exemption to Subdivision Laws
The following is an exemption I would like to use for subdividing some land in Otero county NM. Does it just say I can subdivide every 5 years without going through the Subdivision Act? I want to be sure I understand precisely what can be done.
"The sale, lease, or other conveyance of a single parcel from a tract of land, except from a tract
within a previously approved subdivision, within any five (5) year period; provided that a second
or subsequent sale, lease, or other conveyance from the same tract of land within five (5) years of
the first sale, lease, or other conveyance shall be subject to the provisions of the New Mexico
Subdivision Act and these Regulations; provided further that a survey shall be filed with the
Otero County Clerk indicating the five (5) year holding period for both the original tract and the
newly created tract."

This is an exemption to a subdivision requirement? (Lousy formatting; no context to the original ordinance provided; you're making us guess.) To me it says that you can avoid the requirement if there was an approved subdivision within five years of the sale.
Your best way to get an answer: Ask the person in Otero County who enforces the ordinance.

The original subdivision document is 131 pages long :cool:. Here is the entire document http://co.otero.nm.us/Ordinances/07-02.pdf The exemptions are listed on page 42. The exemption I referenced was #11. The way I read it was I couldn't subdivide if it was already part of an approved subdivision. Am I wrong?
