Ncp pled guilty today to non support. (Michigan Court) The judge stated from Jan '04 to July '07 and he agreed. These dates are a little off but in the area of non payment. Would this be considered abandonment? The sentencing is next month to where I am able to speak at that time. The AG's office of Michigan is handling the case. I am not sure if I had missed something throughout the 2 felony non support pre-trial hearings but the AG's office was hell bent on at least half of the arrearage to be paid if not all and now it doesn't appear to be that way. Since all of this started with the felony - NCP has gotten a "real" job and has payments deducted from his check. (he only claims the one income and not the other) This is the second real job this man has kept since 1995. He kept a "real" job in '03 -'04 to satisfiy the court with payments and then quit - not informing the court. Nor telling me and at that time he was carrying medical insurance on the kids and had that dropped soon after he provided the info to the court that way it kept more in his check and I got stuck with the bills! The job will only last for so long. Regardless if he is now a "felon" and I am told if he now misses a payment he will go to prison. He is paying lower support than what should be for his income with an arrearage amount on top of it. He does not file taxes and has managed to have all assets moved out of his name and into someone elses. He even gave the judge an address that he does not even reside at. Would that be considered a violation against his parole for giving an address that he does not even live at??
What should I say next month when I have the opportunity to speak at his sentencing and what would be most effective way to convey my feelings to the judge??
Right now, I feel like the "deer in the headlights". Why? I am not really sure. It was an odd but satisfying feeling to hear him say "guilty" today......but part of me feels that he will get his hands slapped once more and just get probation. I feel that with his track record of non-payment and doing what benefits him that he will not see this whole ordeal as life changing and will just continue to do what he has done in the past years.
