I went inside this building to buy some weed. To make a long story short, I got to appear in court on 11-27 and am charged w. criminal trespassing ,I had 6 bags of weed on me, the cops took it, and they said that was just a volition. This all happened in NY and this is my 1st time getting arrested, does any one have any idea what the penalty would be. If I should plead guilty or plead not guilty and hope for a good plea barging.
This all happened in Westchester,Ny
Are you sure that the trespassing charge a violation? If so, a conviction will not be treated as a criminal conviction. Violations carry a potential for jail, but are almost always resolved with a fine. You may be able to get a deferment. You may wish to consult a local criminal defense lawyer to determine the court's policies.
The weed was a volitation.criminal tresspassing 140.10,is what my apperance ticket says.
Criminal trespass in the third degree is a class B misdemeanor.
I know it's an old thread.We all replay to a topic and then no one follows with an update most of the time. My end result was an acd for the weed and I got the criminal tresspassing lowered to tresspassing which is a volation.
