Pregnant Prior To Divorce, By a Different Father
regarding Florida State Law - I have been living apart from my husband and father of my one child for over 6 monthes and he has now moved to a different part of the state. My current boyfriend and I just found out I am pregnant. My husband was not the one who wanted the divorce so he has not moved swiftly through the stages of separation ect. and is not spending the money needed to initiate the divorce. I am scrambling to pull the necessary funds together to file and obtain a divorce but I'm now worried about how my pregnancy with my boyfriend may complicate matters. I have tried researching Florida Law on this issue but have been unsuccessful.

Some states won't allow the divorce to occur until the baby is born. I'm checking for your state...

I'm not finding anything that says the bio father cannot sign an affidavit of paternity to be placed on the BC.

'm still a little confused - since the pregnancy is without question not the baby of my husband do I have to disclose the pregnancy to get my divorce? If I have a husband who still is interested in throwing roadblocks in the path of the divorce at times how can he use this information against me if I have to disclose it? Does this complicate the process to the degree that I can not use the online do it yourself divorce process? thank you

Well, yes. It could affect alimony and/or equitable distribution of assets.
