Saving My Home in Bankruptcy
- Can I change from a Chapter 13 to a Chapter 7????
- Can someone give me a number of a good attorney in PA - Pittsburgh area???
I am in PA, in a Chapter 13 bankruptcy, and may lose my home - the very thing I filed to prevent from happening. To make a long story short, my husband became disabled before we filed, I was told I made too much money and didn't have enough debt to file a chapter 7. The court ordered us to sell our second home by September 30, 2007 since there was a small amount of equity in it. However, the previous tenants left that house in such a mess we were unable to show it much less sell it in time, as we were unable to even get them out until July 5th. Now the court wants an amended plan to add an additional $713 a month onto our payment. My husband is losing his disability insurance income at the end of the year, and the additional $713 is my grocery and bill money, I simply cannot afford it. According to my attorney, if I do not make the additional $713 a month, the court can dismiss my plan. Is there any way we can change to a Chapter 7 instead of a 13? Can anyone give me a phone number of another bankruptcy attorney, so that I can get another opinion? My attorney has failed us multiple times, and I do not want to lose my home because of his mistakes.
Some more information on what has happened:
Our attorney failed to file a motion to reimpose automatic stay on our home we are living in, and we found out when the Sheriff served our foreclosure papers. Now the bank wants an additional 10,000 and that is where the additional $713 a month is coming from.
I know that our case is very complicated and complex, but I am mortified that I may now lose my home over this. I am beside myself and just don't know what to do. I appreciate any and all information that can be given me in this matter.
