Recovering a Share of a Jointly Owned House
I have a friend who was serving a twenty year sentence, his mom and dad died leaving the family home to all eight children. Three of the sister took the house from all of the others, went to the jail and forced this person to sign with an attorney who is now a judge. This person has now been released from jail and was recently arrested for sleeping in the house and charged with burglery, nothing was stolen. They have papers showing they had the siblings sign in 2003. One of the brothers is upset because he doesn't recall giving up his ownership and he is upset over what they have done against his baby brother. Is there anything that can be done for them, especially the one that was forced during his imprisionment? He appeared next to the brother to be the only one that knew this existed. Right now he is still in jail behind this charge and is scheduled to appear in court this week. Both brothers are stating they now want them to buy them out. Please help!

He can hire a lawyer and try to attack the validity of the quit claim deed. You haven't given us any facts which would let us know if he has any chance of succeeding.

What facts are you looking for? He was in jail at the time of signing over his share of the house, and said he was told by the attorney the sisters hired that he had no rights while in jail. His brother was shocked to know he also was signed off and does not recall having signed his share over to them?

We know he was in jail. We know he signed a quit claim deed. That's all we know. Tell us everything else which might explain why he shouldn't be held to the quit claim deed.
