How Do I Sue My Landlord
I am in California. We have a commercial and residential lease for over 20 years. Our landlord served us a 30 DAY NOTICE TO TERMINATE on both residential and commercial leases. (It should have been a 60 day)
He served us beacuse we complained to him for not finishing the construction as stated in our ommerical lease agreement.
This resulted us not being able to open our business since March. This resulted in a $85k loss of income. He was then fined by the county for not getting the correct permits.
To date, the construction is not complete, and we have not been able to open.
We have not broken any part of the lease or been late on any payments.
Unlawful Detainer and Unlawful Detainer Answer has been filed.
My question is do I counter sue him? Do I start another suit? What do I do?

Dispute With Landlord
You claim you lost $85,000 in income as a result of the landlord's breach of contract, so I don't know of any reason why you wouldn't want to consider suing.
You would raise your defenses to the eviction action in the eviction suit; you may be able to raise your damages action in that suit. Given the amount of money you claim is involved you should be working with a lawyer.
