Tenant Moved In Way Too Much Stuff
Tenant moved in last week. First one huge U-haul showed up...then another...then another...then pickup truck loads, etc. Bottom line, half of my four car garage, all of my basement and half of the first and second floors are stuffed.
I had no idea before the lease was signed that this would be an issue, so it didn't occur to me to include provisions for "amount of stuff" in the lease. Is that a normal clause that I just overlooked?
Am I stuck until the lease is up (seven months...I wanted it to end on May 31st) or is there some legal recourse (fire hazard, too much stuff for structure, etc.) that I can call on here?
This is in Ohio.
Thanks.
Re: Tenant moved in way too much stuff
is this a shared house?
If not, then you have no reason to complain as long as any germane fire codes or health codes are not breached.
If this is a shared house and the tenant utilizes more than their fair share, you have a complaint but enforcing it may get to be a bit of a problem.
A bit more info would help.
Re: Tenant moved in way too much stuff
This is not a shared house.
The house cannot structurally take it if they try to jam everything that's in the garage and basement into the main living areas, in addition to what they already have up there. It really is an incredible amount of stuff.
I am going back to inspect the property in a couple weeks. I will give them the benefit of the doubt until then.

Unless the belongings comsist of water beds and dep freezers (that are filled), I doubt there is any problem with the stuff. If the house is jeopardized structurally, with typical household items, I would look into fixing your house rather than blaming the tenant.
Most household items are simply not heavy enough to be concerned with unless they impart a large load in a small area.

Sorry if this comes off as rude, but isn't this a site about legal advice? I think you are missing the point of contributing here if you are simply going to question the facts of a situation of which you cannot possibly know more about than the original poster.
Please accept this fact as I present it: It's too much stuff.
Simple question: In the absence of a local ordinance, does Ohio law allow for a dwelling to be packed as if it were a storage unit?

fine. simple answer.
Yes, or more correctly, it does not prohibit it.
as a additional bit of info; Ohio state law would not prohibit it if it was making your house fall down other than it would allow you to bring a suit for damages.
Re: Tenant moved in way too much stuff
I have never heard of such a complaint or any ordinace for such.
I've seen rental houses stuffed to the ceiling and not come crashing down, so, as said earlier, if there is concern as to the structual integrity of the house, that should be addressed....before it is rented out.
