False Report and the Juvenile System
I am experiencing my first experience with someone filing a false police report and the juvenile just system in Florida. First we have hired a criminal defense attorney.

A teenage crack head called the police stating that she had had a gun held to her head by a friend of mine who is 16 yrs old. My friend is completely innocent and no gun has been found. It is pretty much his word against hers. My friend was not read his rights, appear before a Judge, no plea was enter but the Judge just stated detained for 21 days. The police did not take the store clerks statement and noone even knew she had called the police. The police broke the door down with guns drawn asking where my friend was. We didn't even know what happened. My friend found out 6 hours later why he was being detained. And we are not able to get him out of the Juvenile Detention Center. He is a good kid but very street smart.

First, can a statement in writing and notorized be evidence in court? Second, does the person have to appear? Third, how can they detain a child and not offer bail, release to parent, or even release with an ankle bracelet. Fourth, can a Myspace webpage print out be evidence of character in court? Fifth, How can the system detain a child with out being arrested. Sixth, Can someone please explain to me how we treat an innocent child worse that a Convict child killer. I am really going nuts over this.

    What are you talking about?

From what you say, a kid with a record was identified as a suspect in an armed robbery. Yes, the police can arrest the kid. Bail is governed by state law, and if he doesn't like the outcome of his bail hearing he can have his lawyer petition for bail.

Yes, if it's relevant and authenticated.

The suspect was quite obviously arrested.

    They can't, they haven't, and they won't.
