Allegations of Parental Unfitness Due To Alcohol Use
I'm in Oklahoma and in the process of a divorce with my attorney husband. Until recently, upon his request, I have not had an attorney, but recent issues made me reconsider and hire counsel. Upon learning of this information, my h went to court requested and got an emergency custody order claiming--FALSELY--that I was drunk, running into walls and talking to people that weren't there. He had no proof, no evidence, no facts--Just his allegations and the judge granted it. We have a hearing next week. Husband says he is going to get sole custody--no problem. Can he do this without showing any proof of substance abuse??? We are both recovering alcoholics and I have offered DAILY urine tests to prove my sobriety. He says that's not good enough.

Under what circumstances could he have seen the alleged conduct, where nobody else would have witnessed it? In any other circumstances, and perhaps even within those he describes, you should be able to produce witnesses to establish that his allegations are false.
