Misdemeanor Battery Charges Filed One Day Before Year Limit Expires
I live in Nevada...the wife and I had a fight, neither of us raised a hand to each other, I broke a ceramic toothbrush holder and my wife was cut (on the leg) by a piece of ceramic. She called the police, I left and the police came and merely took a report. Now a year later, as a matter of fact, one day short of a year, I'm summoned to court on misdemeanor battery charges. What are the possible outcome(s)? Do I need a lawyer? My wife was planning on seeing the City Attorney to have the charges dropped, is this possible? We've never had any type of domestic complaint before or since. It seems like the City is just trying to file charges before the time limit...if they were really concerned about my wife, why did they leave us be for a year? Any help would be greatly appreciated, I've never been in any trouble my entire life. Thanks

    Fines, probation, jail.

There may be a "first-time offenders" program which provides for the possibility of a deferred sentence. If you wish to take this to trial, I would suggest hiring a criminal defense lawyer.
