Changing Court Dates On The Trial Date
My mom's speeding ticket violation trial is apporaching on Nov 6th but she had to leave for her sister's funeral outside Canada (overseas) which will last until Nov 12th when she can fly back at earliest so this leaves me with having to change her trial date...i was wondering, can i wait until the court date (which is set for Nov 6th) and request for continuance from the judge because my mom is out of the country due to family issues (sudden death in the family)? Or is my only option to file a Notice of Motion requesting this? Ideally i would like to go on the court date to request in front of the judge instead of through paperwork because i genuinely want to explain myself and her situation, and also i gather from the alternate paperwork i will have to drive back to the court (which is about 1 hour drive from me), twice ...while if i wait to court date i just have to explain once (1 drive).

    Thanks for your help.

PS - the court is in Cambridge, Ontario.

Your mom should seek an adjournment prior to her court date.
