If she wants to be emancipated, she has to be emancipated from both parents (assuming she finds a way to emancipate in her state). I don't know what you mean by your suggestion that the father has "no rights". That could mean anything from his not exercising his rights to his having had his rights as a parent previously terminated by a court.
he doesnt have parental rights i believe. He lives in another state so i dont know for sure. Like, he couldnt come take her for a weekend or anything like that. Thats what i mean.
Ok, if the emancipation thing doesnt work, what other routes are there? Im told also (by people that have done it) that in Iowa, when you turn 17 you can decide where to live with no issues. She does turn 17 in about two months exactly, but she feels unsafe in her home and two more months there might be the differance between her having seriouse issues, if not being dead, or getting her out and her being fine. I dont know this kind of stuff, and im just going off what people who have done these things in the past are telling me. People seemed confident on the emancipation, but that got shot down pretty well here. Please help, she needs out, and she cant go to foster care or go live with her real dad. She has a place, a good place, and she can be provided for if she cant provide for herself for any reason, but not if she is still with her mother.
That is false you are under parental authority until you reach age of majority, marry, join Armed forces or, are emancipated
